Official Rules

Purpose

The T-shirt competition is for the purpose of promotion of cannedrevolution.com (the "Sponsor").

Eligibility

The T-shirt competition is open to all users of cannedrevolution.com. Entrants must be 18 years or older or have the permission of his/per parent or legal guardian to participate. Entrants must also satisfy all the requirements set forth in these Official Rules to be eligible to win the prizes.

Participation in this T-shirt competition is void where prohibited by law or in jurisdictions where sweepstakes or lucky draw competitions are prohibited or subject to registration procedures in which the Sponsor has not complied.

The Sponsor, its branch offices and their respective employees are not eligible to participate in or enter the T-shirt competition.

Duration

Entries to the T-shirt competition will be accepted from October 5th, 2004 until midnight on December 5th, 2004 (Hong Kong time) (the "Promotion Period"), provided that the Promotion Period may be shortened or extended at the Sponsor’s sole discretion. Entries received by the Sponsor before October 5th, 2004 or after midnight on December 5th, 2004 (Hong Kong time) are void.

How To Enter

During the Promotion Period, users of cannedrevolution.com may enter the competiton by logging on to the Canned Revolution web site at http://www.cannedrevolution.com, and registering for the T-shirt competition. Entrants are required to fill in the online registration form for the T-shirt competition, answer the 6 questions and submit the registration online.

Use of data and Data Privacy

Personal data of the T-shirt competition entrants will be collected when they enter the T-shirt competition. Please review our Privacy Statement before registering for the T-shirt competition.

Upon entering the T-shirt competition, entrants will be deemed to have "opted-in" to receive mailings from the Sponsor and/or its partners.

By entering the T-shirt competition, entrants irrevocably and unconditionally agree that if they are one of the winners of the T-shirt competition, their names and other information may be used by the Sponsor and/or its advertising and promotion agencies without further notification or compensation.

Agreement To Official rules

Participation in the T-shirt competition constitutes the entrant’s irrevocable and unconditional agreement to and acceptance of these Official Rules, the personal information uses and disclaimers as explained in the Privacy Statement and all decisions of the Sponsor in relation to the T-shirt competition.

Selection and Notification of Winners

The winners of the T-shirt competition will be determined by a random drawing from among all eligible entries to be conducted on the following dates or such other date as the Sponsor may determine appropriate. Two prizes will be given out at the following draw date during the Promotion Period. The potential winners will be notified by e-mail at the email addresses provided by the entrants within 10 days of the draw.

The Sponsor may require the potential winners to provide proof of identity for collection of the prizes, and to complete and return an affidavit of eligibility and a release of liability and publicity within 21 days of the request, or the prize may be forfeited.

If response from a potential winner is not received by the Sponsor within 21 days after the first attempt to contact such potential winner, the prize shall be automatically forfeited and another entrant may be selected by the Sponsor by way of random drawing from the remaining eligible entrants to win the prize in his/her place.

In the event of a tie, or a drawing of more than 5 entries, the tie-breaker answer judged by the Canned Revolution staff to be best shall be used to determine the winner.

Draw Date:

June 1, 2004.

Prizes

5 prizes will be given out at the draw:

One Canned Revolution T-Shirt each, valued at US$ 26.

All taxes (including any luxury tax), fees, surcharges and registration and licensing fees or liabilities relating to the prizes are the sole responsibility of the winner.

A prize will be forfeited if participation of the relevant winner in this T-shirt competition or the T-shirt competition itself is otherwise prohibited by law.

The Sponsor may at any time at its absolute discretion substitute any of the prizes with other prizes of similar value.

Unless otherwise agreed between the winners and the Sponsor, all prizes will be sent by courier service to the winners at the addresses provided by the winners.

The Sponsor will use reasonable efforts, subject to availability, to deliver the prizes within 90 days after a winner is confirmed. The Sponsor, however, shall not be held responsible for any delay in delivery of the prizes. The winners shall bear all, and the Sponsor shall not be responsible for any, risks of loss or damage to the prizes after they have been delivered by the Sponsor. If the prize is not claimed by the winners within 30 days of the date the prize is delivered to such location, the award shall be forfeited and an alternate winner may be selected by the Sponsor.

Disclaimer

All entrants agree that the Sponsor and its agents, representatives, affiliates and employees shall have no liability whatsoever for any injuries, losses, or damages of any kind which may be suffered by the entrants in relation the T-shirt competition, and/or the acceptance, possession, or use of the prizes. The entrants further acknowledges that the Sponsor does not give any warranty, representation, or guarantee express or implied, in fact or in law, relating to any of the prizes, including but not limited to its quality, mechanical condition or fitness for purpose of use.

General

The Sponsor may at any time at its absolute discretion cancel, terminate or suspend the T-shirt competition and/or modify the Official Rules, or disqualify any entrants from participating in the T-shirt competition, including but not limited to circumstances where the Sponsor considers that fraud, infection by computer virus, bugs, tampering, unauthorized intervention, technical failure, human error or any other causes, affect or may affect the administration, security, fairness, integrity, or proper conduct of the T-shirt competition.

In the event of that the T-shirt competition is cancelled, notice will be posted at www.cannedrevolution.com and the Sponsor reserves the right to award the prizes by way of a random drawing from all entries received before the time of cancellation.

The Sponsor shall not be held responsible for incorrect or inaccurate entries or entry submitted by the entrants while online, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor shall not be held responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the T-shirt competition.

governing law and Jurisdiction

The T-shirt competition and the Official Rules are governed by the laws of Hong Kong Special Administrative Region of the People’s Republic of China ("Hong Kong"). Any controversy or claim arising out of or relating to the T-shirt competition or these Official Rules shall be exclusively settled by binding arbitration in Hong Kong in accordance with Hong Kong law. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.
